Yes — without a will, Ontario's Succession Law Reform Act determines how your estate is distributed, which may not reflect your wishes. Dying without a will means the court appoints an administrator for your estate, your assets may not go to the people you intended, and your family may face unnecessary delays, costs, and conflict. A properly drafted will is the single most important step you can take to protect your loved ones.
What is probate and when is it required in Ontario?
Probate is the court process that confirms the validity of a will and gives the executor legal authority to administer the estate. In Ontario probate is called a Certificate of Appointment of Estate Trustee. Not all estates require probate — it depends on the assets involved and whether institutions such as banks or land registry offices require court confirmation before releasing assets. A lawyer can advise whether probate is necessary in your specific situation.
What is a power of attorney and why do I need one?
A power of attorney is a legal document that authorizes someone you trust to make decisions on your behalf if you become mentally or physically incapable. In Ontario there are two types — a power of attorney for property covering financial decisions and a power of attorney for personal care covering health and lifestyle decisions. Without these documents in place, your family may need to apply to court to manage your affairs — a costly and time-consuming process that a simple power of attorney prevents.
Can a will be contested in Ontario?
Yes — a will can be contested in Ontario on several grounds including lack of testamentary capacity, undue influence, fraud, or improper execution. A successful challenge can result in the will being set aside entirely or specific provisions being invalidated. Estate litigation is complex and time-sensitive. What does an executor do in Ontario?
An executor is the person named in a will to administer the estate. How long does estate administration take in Ontario?
Simple estates with a clear will and straightforward assets can be administered in six to twelve months. More complex estates involving real property, business interests, tax issues, or family disputes can take significantly longer — sometimes two years or more. Executors are generally advised to wait at least one year before making final distributions to ensure all debts, taxes, and claims have been addressed.
What happens if someone dies without a will in Ontario?
Dying without a will in Ontario is called dying intestate. The estate is distributed according to the Succession Law Reform Act regardless of the deceased's actual wishes. A spouse and children receive priority under the Act but the formula may not reflect what the deceased would have wanted. Common law partners have no automatic inheritance rights without a will. The court appoints an administrator and the process is typically longer and more costly than administering a properly drafted estate.
